Arbitrary proceedings are preferred by a majority of our clients who have businesses in Bulgaria, EU and other countries. There are some extracts from the website of the arbitrary court at the Bulgarian Chamber of Commerce and Industry.

Advantages of arbitrary proceedings

• Avoiding the competence of regular state courts, both parties rely on a non-governmental legislative body which they trust to solve their argument.
• The parties participate in the establishment of the ruling body through their choice of arbiters.
• The solution of the argument is reached by following a simplified procedure which both parties are aware of in advance. They can change in or adapt it to the particularities of the argument.
• The parties rely on arbiters with special knowledge which ordinary judges do not always possess.
• Fast speed is one of the biggest advantages of arbitration. Proceedings are one- instanced. The normal length of a case is 6-9 months.
• Arbitrary decisions are final; they are voluntarily enforced and are stable as they can be attacked only in claim order.
• Arbitrary proceedings are cheaper. The collected fee is not a constant percent but decreases with the increase of the claim.
• Expenses for defense, expert witnesses, translators etc. are paid only in one instance.
• Arbitrary proceedings are non- public and confidential which makes it possible to avoid possible deterioration in the parties' relationships.
• Arbitration is exempt from the restrictions of international dependence valid for state courts.
• The non- breaching party can avoid the necessity, inconvenience, expenses and inequality of administering a suit against the breaching party abroad.
• Since both parties have turned to arbitration voluntarily, it is more likely to retain good business relationships.
• The enforcement of an arbitrary decision abroad is ensured by the New York convention to a much higher degree than the enforcement of decisions reached by state courts.
